Canon 43 of the Council of Agde (Gaul, AD 506) forbids the ordination of penitents for presbyters. Penitents who have been already ordained should keep their status but, are prohibited from saying Mass.
[Titulum secundum cod. A] XLIV [sic!]. De paenitentibus et incertis ordinatis.
[Titulum secundum cod. R] XLII [sic!]. De paenitentibus neminem promouendum sicut de bigamis aut internuptarum maritis ac ut consecrare prbri altario prbr non praesumat.
[Titulum secundum coll. Hispanam] XLIII. Ne de poenitentibus clericus ordinetur, et ut presbyter altare non erigat.
 
De paenitentibus id placuit obseruari, quod sancti patres nostri synodali sententia statuerunt, ut nullus de his clericus ordinetur; et qui iam sunt per ignorantiam ordinati, ut sicut bigami aut internuptarum mariti locum teneant. Ministrare diaconus aut consecrare <in> altari huiusmodi presbyter non praesumat.

[Title according to the Hispana collection] XLIII. No penitent should be ordained a cleric, and that a presbyter should not erect an altar.
 
Concerning the penitents this should be observed, as is stated by the decrees of our blessed synodal fathers, that none of them should be ordained a cleric; and those, who were already ordained through ignorance, as in the case of those twice married and those married to wives who were married earlier to someone else, should keep their place. Deacons, [however], should not dare to minister and presbyters should not dare to consecrate [i.e. say Mass] at the altar.

The Council of Agde was held in September of 506 under the auspices of Cesarius, bishop of Arles, and with the permission of the Visigothic King Alaric. The first 47 canons are considered genuine, since only those are present in the oldest codices. The rest, present in some manuscripts, must have been taken from the other council acts, especially those of the Council of Epaone in 517. This council was attended by 24 bishops, and 8 presbyters and 2 deacons, who represented their bishops. More on the council, see Klingshirn 1994, 97-104.
