[Titulum ex cod. A, R] XXIV. De his qui duplicata matrimonia incederunt.
[Titulum ex Collectione Hispana] XXV [sic!]. De uiris probatis.

(ed. Munier 1963: 84, 91-92)
[Title from the codex M] XXIV. Concerning proper and proven men.
[Title from the codices A, R] XXIV. Concerning those who enter into a second marriage.
[Title from the Hispana Collection ] XXV [sic!]. Concerning proven men.

Concerning those suitable and proven men, whose grace of life in itself suggests their being accepted to clerical office, if by chance they entered into the second marriage, they should not assume higher ecclesiastical positions than those of subdeacons.

Discussion:

This canon is repeated in the so-called Second Council of Arles as canon 45 (44) (see Munier 1963: 123; e.g. [549]). This redaction of the said canon also commands to demote those twice-married who were already ordained to higher ecclesiastical positions. The canon of course refers to those men who, before entering the second marriage, were widowers.
