Canon 4 of the First Council of Orange (Gaul, AD 441) grants clerics the right to do penance.

Discussion:

This canon is repeated in the so-called Second Council of Arles as canon 29 (28) (see Munier 1963: 120; e.g. [549]).
 
It is quite possible that clerics who have committed a sin were seen as unfit to perform clerical duties, and therefore should resign from their office, and consequently perform penance as laymen.
