Canon 3 of the Sixteenth Council of Toledo (Iberian Peninsula, AD 693) imposes punishments on clerics who committed a homosexual act.
Canon 3
 
De sodomitis.
 
[…] At nunc quoniam haec funesta actio et sodomiticae operationis malum multos sauciasse perpenditur, adeo nos ob huius foedissimae causae extirpandam consuetudinem zelo Domini ardentes omnes in commune sanccimus, ut quique huius nefariae actionis patratores extiterint quique in his turpitudinibus sese implicari permiserint et contra naturam masculi in masculos hanc turpitudinem operaverint, si quidem si episcopus, presbyter aut diaconus fuerit, de proprii honoris gradu deiectus perpetui exili manebit damnatione perculsus; sin vero cuiuslibet ordinis, gradus sive personae et alterius colluvionis noxiis reperti fuerint inplicati, illius legis quae de talibus est edita nihilominus ferientur sententia atque ab omni christianorum sint alieni caterva, et insuper centenis verberibus correpti ac turpiter decalvati exilio mancipentur perpetuo; ita ut nisi tam eos qui religionis cultum turpasse visi sunt quam etiam alios, ut diximus, cuiuscumque ordinis homines digna satisfactio poenitentiae accipere corpus et sanguinem Christi in fine permiserit, aut christicolarum societati redierit, nec in exitus sui die secundum canonum instituta communionis perceptione se noverint relevari nec catholicorum coetui adgregari.

Canon 3
 
On the sodomites.
 
[...] And now, because it is known that this deathly act and wrong of the sodomitical deed have wounded many people, therefore we, fervent with the zeal of the Lord to extirpate this filthy custom, decree that perpetrators of this nefarious act who agreed to implicate themselves in this obscenities and as a male with a male did this obscenity against nature - if [one guilty of such thing] is a bishop, presbyter, or a deacon, he shall be removed from his grade and condemned with a perpetual exile. If he is of another order, grade, or another personal status and has been found involved in this noxious filth, he shall receive the punishment prescribed by this law and shall be rejected from the Christian community, and moreover flogged with one hundred lashes, badly decalvated, and sent to the perpetual exile. And those who polluted the religious cult as well as the other people, as we have said, of whatever order shall know that they will not be raised up to receive the communion even on the day of death according to the institutions of the canons nor rejoined with the community of the Catholics unless having satisfied the worthy penance they will be permitted to receive the body and blood of Christ.

The Sixteenth Council of Toledo gathered on 2 May 693 during the reign of King Egica. 54 bishops were present, three bishops sent representatives. There were also the abbots and lay dignitaries present. The tomus of Egica, which precedes the creed and canons in the acts, was issued one week before the council on 25 April (Orlandis, Ramos-Lissón 1986: 478-480). The council convened in the afthermath of the coup against Egica organized by Bishop Sisebert of Toledo (Collins 2004: 106-107).
